Terms & Conditions

These Terms & Conditions govern your use of https://jab.sg (the “Site”), operated by JAB Design Pte Ltd (“JAB Design”, “we”, “our” or “us”).

By accessing or using the Site, you agree to these Terms & Conditions. If you do not agree with them, please discontinue use of the Site.

These Terms apply only to use of the Site. Any engagement of JAB Design for consulting, branding, design, campaign, editorial, digital or other professional services will be governed by the relevant proposal, quotation, contract or written agreement. Where there is any inconsistency, the terms of that specific agreement will prevail for the relevant engagement.

Website Security and Scammer Alert

JAB Design has identified multiple fraudulent websites, lookalike domain names, online profiles and communications that have copied or imitated our company name, branding, website content or business identity in attempts to mislead members of the public.

Our official website is https://jab.sg. Official company email addresses use the @jab.sg domain.

You should exercise caution if a website, advertisement, social media profile, message or email claims to represent JAB Design but uses another domain, unfamiliar contact details or unusual payment or information requests.

Ownership of the Site and Its Content

Unless otherwise stated, the Site and the original content created by JAB Design are owned by or licensed to JAB Design Pte Ltd and are protected by applicable intellectual property laws.

This includes, without limitation:

• articles, copywriting, editorial content and case studies;
• brand strategies, frameworks, methodologies and presentations;
• logos, identity systems, campaign concepts and creative directions;
• photographs, illustrations, graphics, infographics and layouts;
• videos, animations, audio and multimedia content;
• website design, page structure and distinctive visual presentation;
• downloadable documents, guides, maps, reports and other files; and
• other original works, materials and source content published on the Site.

Copyright protects the original expression of ideas, not ideas in the abstract. Nothing on the Site grants any licence or right to use our intellectual property except as expressly stated in these Terms or permitted by applicable law.

Client, Partner and Third-Party Materials

The Site may display client names, trade marks, logos, photographs, illustrations, music, videos, excerpts, publications, campaign materials and other third-party content in connection with our work, case studies, commentary or professional history.

Ownership of those materials remains with the respective rights holders unless otherwise stated. Their appearance on the Site does not imply that JAB Design owns all rights in them or that any third party endorses every statement appearing on the Site.

JAB Design respects the intellectual property rights of others. Where third-party materials are used, they are used with permission, under licence, in accordance with applicable law, or with attribution where required or appropriate.

If you believe that material appearing on the Site infringes your intellectual property rights or has been used in error, please contact us at info@jab.sg so that we may review the matter and take appropriate action where necessary.

Permitted Use

You may access and use the Site for lawful, personal, informational and non-commercial purposes.

You may share links to publicly accessible pages of the Site, provided that you do not misrepresent the source, alter the destination or imply an endorsement, partnership or association that does not exist.

Except as permitted by applicable law or with our prior written permission, you must not:

• copy, reproduce, republish, upload, post, transmit or distribute substantial parts of the Site or its content;
• adapt, modify, translate, transform or create derivative works from our content;
• use our content for commercial, promotional, competitive or resale purposes;
• remove copyright notices, credits, watermarks or other ownership information;
• frame, mirror, clone or reproduce the Site or any substantial part of its design, structure or presentation;
• use any logo, name, trade mark, visual identity or material in a manner that suggests a false association with JAB Design;
• misrepresent our work as your own or as the work of another organisation;
• use the Site in a manner that may damage, disable, overburden or impair its operation or security; or
• attempt to gain unauthorised access to the Site, its hosting environment, systems or data.

Artificial Intelligence, Automated Access and Content Generation

Except where permitted by applicable law or expressly authorised by JAB Design Pte Ltd in writing, you must not use the Site or its content for automated scraping, large-scale extraction, dataset creation, machine learning, artificial intelligence model development, text and data mining or similar automated purposes.

This restriction applies to the automated collection or reuse of our articles, copywriting, case studies, frameworks, methodologies, presentations, photographs, illustrations, graphics, branding assets, layouts, videos, downloadable materials and other original works.

You must not use our content, work or visual references to generate, prompt, direct or produce AI-created text, images, videos, designs, websites, brand identities, logos, campaign concepts or other outputs that:

• substantially reproduce or imitate protected elements of our original work;
• copy substantial parts of our articles, case studies, layouts or creative materials;
• are presented as having been created, endorsed or approved by JAB Design when they were not;
• misrepresent the identity, services, reputation or business of JAB Design; or
• otherwise infringe intellectual property, confidentiality, privacy, passing-off or other legal rights.

Nothing in this section is intended to restrict lawful search-engine indexing, ordinary browsing, reasonable quotation with proper attribution, or any use expressly permitted under applicable law.

Use of AI-Assisted Services

JAB Design may use artificial intelligence (“AI”) tools to support research, drafting, proofreading, transcription, ideation and certain administrative tasks in the course of providing our services.

AI-assisted outputs are subject to human review and professional judgement before delivery to the Client. JAB Design remains responsible and accountable for the services and deliverables provided under this Agreement.

Unless the Client has expressly authorised otherwise in writing, JAB Design will not use the Client’s confidential information or personal data to develop or train generative AI models. The collection, use and protection of personal data are governed by JAB Design’s Privacy Policy.

JAB Design will take reasonable steps to safeguard all confidential information provided by the Client, including where AI-assisted tools form part of JAB Design’s internal workflow.

Computational Data Analysis

Singapore law may permit certain copying or communication of lawfully accessed material for computational data analysis where the statutory conditions are satisfied.

Nothing in these Terms limits any right that cannot lawfully be excluded. However, access to the Site does not by itself grant permission to reproduce, publish, distribute, commercialise, misrepresent or create infringing derivative works from our content.

Website Cloning, Impersonation and Passing Off

You must not copy or imitate the Site, our branding, business identity, content or presentation in a manner that is likely to mislead others into believing that another website, domain name, profile, business or communication is operated by, affiliated with or endorsed by JAB Design.

This includes the registration or use of deceptive or lookalike domain names, email addresses, social media profiles, advertisements, AI-generated materials or other digital assets intended to imitate or misrepresent JAB Design.

We reserve the right to investigate and take appropriate action against unauthorised copying, impersonation, deceptive domain use, infringement or misuse of our identity and content.

Trade Marks and Brand Names

The names, logos, marks and distinctive brand elements appearing on the Site may be trade marks, registered trade marks or other protected identifiers belonging to JAB Design, our clients, partners or third parties.

No use of any trade mark, business name, logo or brand element is permitted without the consent of the relevant rights holder, except where allowed by applicable law.

Downloads and Shared Materials

Documents, guides, maps, reports, images, videos and other materials made available for download remain subject to the ownership, licence, attribution and usage conditions stated on the relevant page or within the material itself.

Unless expressly stated otherwise, making a file available for download does not transfer ownership or grant permission for commercial reuse, alteration, redistribution, resale or incorporation into another work.

Accuracy and General Information

The content on the Site is provided in good faith for general information, commentary, portfolio, educational and promotional purposes.

Although we take reasonable care in preparing and maintaining the Site, we do not warrant that all information will always be complete, current, accurate or suitable for every purpose.

Nothing on the Site should be treated as legal, financial, accounting, medical or other regulated professional advice. You should obtain advice appropriate to your circumstances before acting on information that may affect your rights, obligations or business decisions.

Professional and Consulting Content

Articles, frameworks, observations, case studies and examples published on the Site are general in nature and may not be suitable for every organisation, project or situation.

No consultant-client, agency-client, fiduciary or other professional relationship is created merely because you access the Site, read its content or contact us.

The Site may contain links to websites, platforms or services operated by third parties.

JAB Design does not control and is not responsible for their availability, security, accuracy, content, privacy practices or terms. A link does not necessarily imply endorsement.

Your use of any third-party website or service is subject to that third party’s own terms and policies.

We may update, suspend, restrict or discontinue any part of the Site at any time without notice.

We do not guarantee that the Site will always be available, uninterrupted, error-free or free from viruses or other harmful components.

You are responsible for using appropriate security measures, keeping your devices and software updated, and exercising caution when accessing links or communications that claim to represent JAB Design.

Limitation of Liability

To the fullest extent permitted by law, JAB Design Pte Ltd will not be liable for any indirect, incidental, special or consequential loss arising from or connected with your use of, inability to use, or reliance on the Site or its content.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

Indemnity

To the extent permitted by law, you agree to indemnify JAB Design Pte Ltd against claims, losses, liabilities, costs or expenses arising from your unlawful use of the Site, infringement of third-party rights, unauthorised use of our intellectual property, impersonation of our business or breach of these Terms.

Privacy

Our collection and handling of personal data through the Site are governed by our Privacy Policy.

Changes to These Terms

JAB Design may update these Terms & Conditions from time to time to reflect changes in the Site, our practices, technology or applicable requirements.

The revised Terms will be published on this page with an updated revision date. Your continued use of the Site after the revised Terms are published constitutes acceptance of the updated Terms.

Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

Governing Law and Jurisdiction

These Terms & Conditions are governed by the laws of Singapore.

Any dispute arising from or connected with the Site or these Terms will be subject to the jurisdiction of the courts of Singapore, unless otherwise agreed in writing or required by applicable law.
